Service Under Article 10 Hague Service Convention
When a country or state is contracting member to the Hague Convention, Article 10 of the Convention allows us to completely bypass the slow Central Authority queues and use faster, direct methods of service – provided the destination country has not formally objected to them.
Depending on the country where your defendant is located, we utilise three primary Article 10 channels:
- Article 10(a) – In countries that allow it, we can legally effect service by sending the documents directly to the defendant via international registered mail or secure express couriers (like DHL or FedEx).
- Article 10(b) – This allows judicial officers (such as solicitors and lawyers), officials or other competent persons (such as process servers) of the origin state to serve legal documents directly through judicial officers, bailiffs, or competent persons (such as process servers) of the destination state.
- Article 10(c) – This allows litigants in person or their legal teams to coordinate service straight with local authorities or process servers abroad without going through the central authority.
